These Terms of Use govern your use of the IBVC.com website and services. By accessing or using our website, you agree to be bound by these Terms of Use, our Privacy Policy, and our SMS messaging terms. Message and data rates may apply. Reply STOP to opt out at any time.
1. Company Overview
IBVC Inc. ("IBVC," "we," "us," or "our") is a financial technology company registered with the Florida Department of State. IBVC facilitates the recovery, acquisition, and management of distressed assets, including court judgments, real estate interests, surplus proceeds, and related financial matters. IBVC is not a law firm and does not provide legal services. IBVC is not a financial advisor and does not provide financial, tax, or investment advice.
2. No Legal or Financial Advice
Nothing on this website or in any communication from IBVC constitutes legal advice, financial advice, tax advice, or investment advice. All information provided by IBVC, whether on this website, by phone, by email, by text message, or in person, is for informational purposes only and should not be relied upon as a substitute for professional counsel.
You are strongly encouraged to consult with your own licensed attorney, financial advisor, or tax professional before making any decisions related to your case, property, assets, or financial situation. IBVC makes no representations or warranties regarding the legal or financial implications of any transaction.
Any attorneys, notaries, or other licensed professionals retained or engaged by IBVC act on behalf of IBVC and represent the interests of IBVC only. These professionals do not represent you, are not your attorneys, and do not owe you a duty of care, fiduciary duty, or attorney-client privilege. If you require personal legal representation, you must retain your own independent counsel at your own expense.
3. Services and Transactions
IBVC offers services across the following categories:
- Payout+ (Court Judgment Recovery): IBVC acquires court judgments (Small Claims, Eviction, Civil) and pays the judgment holder a calculated payout. IBVC then pursues collection at its own expense and risk.
- Liquidity+ (Real Estate Interest Acquisition): IBVC acquires partial or full real estate interests from property owners. IBVC sets the purchase price based on its own valuation methodology.
- Claim+ (Surplus Recovery): IBVC identifies, verifies, and recovers surplus funds from tax deed sales, foreclosures, partition sales, and government-held accounts.
- Estate / Probate: IBVC coordinates with IBVC-verified partner firms to facilitate probate administration, title clearance, and heir payout distribution.
- Finance / Foreclosure Intervention: IBVC coordinates with IBVC-verified partner firms to provide foreclosure intervention, creditor payoff, and property preservation services.
All transactions are subject to eligibility verification, case review, and IBVC's sole discretion to accept or decline any case. Submission of a form or inquiry does not create a contractual relationship, obligation, or guarantee of service.
4. No Guarantee of Outcomes
IBVC does not guarantee any specific outcome, payout amount, recovery amount, timeline, or result. Payout amounts, eligibility determinations, and case timelines are estimates only and may change based on case developments, jurisdictional requirements, court rulings, or other factors outside IBVC's control. Past results do not guarantee future outcomes. Testimonials on this website reflect individual experiences and are not indicative of results you should expect.
5. IBVC-Verified Partners
IBVC works with independent third-party firms designated as "IBVC-verified partners," including but not limited to The Probate Law Group and New York Financial Corp. These partners are independent legal entities. They are not subsidiaries, affiliates, employees, or agents of IBVC. IBVC's verification indicates that the partner has met IBVC's internal review criteria at the time of verification and nothing more. IBVC does not guarantee the performance, advice, services, or outcomes provided by any IBVC-verified partner. Your engagement with an IBVC-verified partner is governed by separate terms between you and that partner. IBVC assumes no liability for acts, omissions, negligence, or misconduct of any IBVC-verified partner.
6. EARN Program — Independent Contractor Terms
The IBVC EARN program connects independent contractors ("Providers") with task-based work opportunities, including but not limited to property scouting, notice delivery, notarization, photography, and legal services. By applying to or participating in the EARN program, you acknowledge and agree to the following:
a. Independent Contractor Status
Providers are independent contractors, not employees, agents, or representatives of IBVC. No employment relationship, joint venture, partnership, or agency is created by participation in the EARN program. IBVC does not control the manner, method, or means by which Providers perform assigned tasks. Providers are responsible for their own tools, equipment, transportation, insurance, licenses, and tax obligations.
b. No Benefits or Protections
Providers are not entitled to employee benefits, workers' compensation, unemployment insurance, health insurance, retirement benefits, or any other employment-related benefits from IBVC.
c. Assumption of Risk
Providers assume all risk associated with the performance of tasks, including physical injury, property damage, legal liability, and third-party claims. IBVC is not responsible for any injury, loss, damage, or liability that arises during or as a result of task performance.
d. Platform-Only Transactions
All payments for tasks must be processed through the IBVC platform. Providers and clients are strictly prohibited from arranging, soliciting, or accepting payments outside of the IBVC platform. Violation constitutes grounds for immediate removal and forfeiture of pending payments.
e. No Guarantee of Work
IBVC does not guarantee the availability, frequency, or volume of tasks. Task assignments are made on a first-accept, first-assigned basis and may be revoked at IBVC's discretion.
f. Background and Compliance
IBVC reserves the right to conduct background checks, verify licenses, and require compliance with applicable laws and professional standards. IBVC may remove any Provider from the program at any time, for any reason, with or without notice.
g. Confidentiality
Providers may have access to confidential case information, client data, and proprietary IBVC processes. Providers agree not to disclose, copy, or use any such information for any purpose other than performing assigned tasks. This obligation survives termination of the Provider relationship.
7. Intellectual Property
All content and functionality on the IBVC website, including text, graphics, logos, icons, images, videos, concepts, know-how, tools, frameworks, software, algorithms, models, processes, and industry perspectives (collectively, "Site Content"), are the exclusive property of IBVC or its licensors and are protected by U.S. and international copyright laws.
8. Use of Site Content
IBVC grants you a limited, non-exclusive, non-transferable, revocable license to access and download, display, and print one copy of the Site Content solely for your internal, business use, provided that you do not modify the Site Content, retain all copyright and proprietary notices, and comply with these Terms of Use.
9. Limitation of Liability
To the maximum extent permitted by applicable law, IBVC, its officers, directors, shareholders, employees, agents, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your use of or inability to use the website or services; (b) any transaction or relationship between you and any third party, including IBVC-verified partners or EARN Providers; (c) unauthorized access to or alteration of your data; or (d) any other matter relating to the website or services. IBVC's total cumulative liability for all claims arising out of or relating to these Terms shall not exceed the amount you paid to IBVC, if any, in the 12 months preceding the claim.
10. Indemnification
You shall indemnify, defend, and hold harmless IBVC and its affiliates, officers, directors, shareholders, employees, agents, and representatives from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) incurred in connection with: (a) your use of the website or services; (b) your breach of these Terms of Use; (c) your violation of any law or regulation; or (d) your violation of any rights of a third party.
11. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms of Use or your use of IBVC services shall be resolved through binding arbitration administered in Hillsborough County, Florida, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action lawsuit. This arbitration agreement survives termination of these Terms.
12. Third-Party Websites and Providers
IBVC may provide links to third-party websites or incorporate third-party content, but has no responsibility for such websites or content, which are governed by their respective terms of use and privacy policies.
13. Modification of Terms
IBVC reserves the right to modify these Terms of Use at any time. Changes take effect upon posting to the website. Continued use of the website after any modification constitutes acceptance of the revised Terms.
14. Governing Law
These Terms of Use are governed by the laws of the State of Florida without reference to the principles of conflicts of laws.
